Splose $25,000 AUD Prize Giveaway - Terms and Conditions

These Terms and Conditions set out how an individual participates in the Giveaway that is detailed in these Terms and Conditions, which is conducted by Splose Pty Ltd ACN 614 286 636 (we, us, our, Splose). By entering the Giveaway, you acknowledge that you have read, understood and accept and agree to be bound by these Terms and Conditions.

1. Eligibility

a) The ‘Splose $25,000 AUD Prize Giveaway’ (Giveaway) is open to all Splose customers who migrate from their current system to Splose (you, your, Entrant) in the months of November 2023 and 31 December 2023, including those who have already booked their data migration during this period (Giveaway Period).

b) To be eligible for this Giveaway, Entrants must:

(i) complete the migration and begin signing up to use Splose for no less than 3 months during the Giveaway Period; and

(ii) register for the Giveaway by contacting the Splose Sales team or designated Onboarding specialist.

2. Prize Details

a) The total prize pool for the Giveaway is $AU25,000 (Prize Pool).

b) The one-off prizes are awarded in the form of Prezzee egift cards (Prize) based on the total number of practitioners who have migrated from your current system to Splose as follows:

3. Giveaway Period

Prizes will continue to be available to be awarded under the Giveaway until the earlier of the conclusion of the Giveaway Period (being 31 December 2023) or when the Prize Pool has been exhausted, whichever comes first. For the avoidance of doubt, for the purposes of this paragraph, ‘been exhausted’ means where Prizes equal to an aggregate value of $AU25,000 have been awarded to Entrants during the Giveaway Period.

4. General Terms

a) The Prizes are non-transferrable and cannot be exchanged for cash or any other form of payment.

b) Entrants can only receive one Prize based on the total number of practitioners migrated. For the avoidance of doubt, an Entrant who has received a Prize (and that Entrant’s associated employees, contractors, agents, shareholders, officers, directors, relatives or other related parties or associates) shall not be eligible for any other Prize(s), under any circumstances.

c) Splose reserves the right to amend, modify, suspend, or terminate the Giveaway or these Terms and Conditions at any time, for any reason, without prior notice.

d) If the Prize (or any part) is unavailable due to circumstances outside of our control, we may, substitute the Prize (or that part of the Prize) with another prize to the equal value and a reasonably similar specification.

e) Entrants must comply with these Terms and Conditions, and all applicable laws and regulations when participating in this Giveaway. An entry will be deemed invalid where we, in our sole discretion, determine that the Entrant has breached these Terms and Conditions, or engaged in any unlawful or improper conduct.

f) Entrants are not eligible for any refund of their subscriptions with Splose under any circumstances.

g) Splose will use reasonable endeavors to issue the Prizes to the respective Entrants within 3 months of the migration date (as determined by Splose).

h) Any of our employees, their relatives or any of their related parties or associates are ineligible to enter the Giveaway.

5. Privacy Policy

We may collect and use the ‘personal information’ (as defined in the Privacy Act 1988 (Cth)) of Entrants in connection with this Giveaway in accordance with Splose's Privacy Policy (available at www.splose.com.au/privacy). Entrants consent to us using their full name, state of residence, likeness, image, voice and any content relating to them (e.g. photography, film or other recordings) in connection with and/or for the purposes of conducting the Giveaway.

6. Liability

Splose is not responsible for any technical or other issues that may prevent participation in the Giveaway. By participating in the Giveaway, Entrants forever release and hold Splose harmless from any claims, losses, or liabilities arising in any way in connection with the Giveaway.

7. Severance

Part or all of any clause of these Terms and Conditions that is unenforceable or illegal will be severed from the Terms and Conditions and will not affect the enforceability of the remaining provisions of the Terms and Conditions.

8. Waiver

Failure to enforce any of our rights at any stage does not constitute a waiver of those rights.

9. Governing Law

These terms and conditions are governed by the laws of South Australia and any disputes will be subject to the exclusive jurisdiction of the South Australian courts.
